「請求項の限定的縮減」　⇒　"Restriction of Claim(s)"

「発明特定事項を限定する補正」　⇒　"the amendment for restricting a matter specifying the invention"

「独立して特許可能」　⇒　"independently patentable"


「第17 条の2 第5 項第2 号に該当する補正と認められても、補正後の請求項に記載されている事項により特定される発明が特許可能なものでなければならない。」

"Notwithstanding the amendment being deemed as falling under Article 17bis(5)(ii), the invention specify by the matters stated in the amended claim shall be patentable."



「この要件が課されるのは限定的減縮に相当する補正がなされた請求項のみであり、これに相当しない「誤記の訂正」又は「明りょうでない記載の釈明」のみの補正がなされた請求項及び補正されていない請求項については、独立して特許を受けることができない理由が存在する場合において、それを理由として補正を却下してはならない。」

「独立して特許可能かどうかについて適用される条文は、第29 条、第29 条の2、第32 条、第36 条第4項第1 号又は第6 項(第4 号は除く）、及び第39 条第1 項から第4 項までとする。その他の取扱いは「第Ⅸ部 審査の進め方 第2 節 各論」の6.2.3 による。」
